In view of these rulings, it is not surprising that the use of arbitration tribunals by private sector companies and employers has increased significantly. While the Concepcion decision was read in such a way as to exclude most unscrupulous challenges from employment arbitration, there is another line of argument by which some have invalidated the waiver of the right to class or class action. This is the argument that the prohibition of collective actions would nullify the applicants` material legal rights. The most damaging development in arbitration is the linkage between arbitration and class action waivers. In the late 1990s, large corporations began introducing class action bans in arbitration clauses for consumer transactions. . . .
